1. Acceptance of Terms
By downloading, installing, or using the Evriwhere mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Evriwhere is operated by Nyne Apps ("we", "us", or "our"). We reserve the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.
2. Description of Service
Evriwhere is a cross-listing platform that allows users to manage and list their inventory across multiple online marketplaces. The App provides tools for:
- Creating and managing product listings
- Cross-posting inventory to connected marketplaces
- Tracking sales and inventory across platforms
- Managing pricing and product information
3. User Accounts
To use certain features of the App, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities under your account
You must be at least 18 years old to create an account and use the App.
4. Subscriptions and Payments
Evriwhere offers subscription-based services. By subscribing, you agree to:
- Pay all applicable fees for your chosen subscription plan
- Automatic renewal of subscriptions unless cancelled before the renewal date
- Subscription fees are non-refundable except as required by law
Pricing and features may change with notice. You can manage or cancel your subscription through your Apple App Store account settings.
5. Acceptable Use
You agree not to use the App to:
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- List counterfeit, illegal, or prohibited items
- Engage in fraudulent or deceptive practices
- Interfere with or disrupt the App or its servers
- Attempt to gain unauthorized access to any part of the App
- Use automated systems or bots in a manner that violates marketplace terms
6. Third-Party Marketplaces
The App integrates with third-party marketplaces (such as eBay, Poshmark, Depop, and others). You acknowledge that:
- You must comply with each marketplace's terms of service
- We are not responsible for actions taken by third-party marketplaces
- Marketplace integrations may change or become unavailable
- Your marketplace accounts may be subject to their own fees and policies
7. Intellectual Property
The App, including its design, features, and content, is owned by Nyne Apps and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.
You retain ownership of the content you create using the App, including your product listings and images.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR ANY SALES, REVENUE, OR BUSINESS OUTCOMES RESULTING FROM YOUR USE OF THE APP.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NYNE APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE APP.
10. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination:
- Your right to use the App will immediately cease
- We may delete your account data
- Provisions that should survive termination will remain in effect
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Nyne Apps operates, without regard to conflict of law principles.
